Prolog
Di awal tulisan ini, penulis ingin sedikit berpendapat tentang ketidaksukaan penulis terhadap sekelompok orang yang mengaku ‘wakil islam’dalam setiap pembenaran perbuatan mereka yang sama sekali tidak terpuji, seperti kerusuhan, pengrusakan, terror bahkan sampai pembunuhan atas nama kebenaran agama. Sungguh hal tersebut tidak mencerminkan sikap seorang yang memiliki agama, karena beragama berarti memanusiakan manusia, bukankah agama diturunkan untuk manusia? Jadi sifat dasarnya adalah peri kemanusiaan. Terlebih jika hal tersebut dikaji dari sudut pandang kepentingan Indonesia, maka eksklusifitas dalam beragama hanya akan membuat perpecahan bangsa.

Jakarta - A session of the UN Human Rights Council meeting requested the Government of Indonesia to investigate properly the attacks on minorities and religious intolerance. A public hearing on the UPR review of Indonesia was attended by delegations from 74 countries, the UN Human Rights Council 24 members and 47 observers. The UPR Working Group session on Indonesia noted a number of things to watch. One is to question some of the religious intolerance in Indonesia and in protecting the rights of religious minorities.On that session, Indonesian Minister of Foreign Affairs, Marty Natalegawa in his speech says that Government of Indonesia recognizes there are groups that had expressed strong views tend to be extreme and so contrary to the principles of democracy. Strangely, Natalegawa didn’t mention any reason behind the domestic conflict such as religious desecration and defamation that grows liberally. He is busy proclaiming that Indonesia will promote and protect human rights, without realizing this issue is only one sided and politically.In this session, Natalegawa also addressed to critics from several NGO’s that highlights the issue of intolerance for certain groups which carried out the minorities in Indonesia, such as the issue of establishment of several churches, the persecution of the Ahmadiyya, and banning a book discussion, but again he could never explain reasons behind all of this thing called ‘intolerance’.Natalegawa, as a representation of Indonesian Government stated that there is a progress about the protection of minorities, there are several positive developments achieved in Indonesia. One of them, the Government has carry out some positive efforts to suppress religious intolerance. Di antara ciri khas Ahlussunnah Wal-Jama’ah adalah mengikuti pola bermadzhab dalam amaliah sehari-hari terhadap salah satu madzhab fiqih yang empat, yaitu madzhab Hanafi, Maliki, Syafi’i dan Hanbali. Bahkan menurut al-Imam Syah Waliyullah al-Dahlawi (1110-1176 H/1699-1762 M), pola bermadzhab terhadap suatu madzhab tertentu secara penuh telah dilakukan oleh mayoritas kaum Muslimin sejak generasi salaf yang saleh, yaitu sejak abad ketiga Hijriah. Karenanya, sulit kita temukan nama seorang ulama besar yang hidup sejak abad ketiga hingga saat ini yang tidak mengikuti salah satu madzhab fiqih yang ada.
Belakangan setelah lahirnya gerakan Wahhabi di Najd Saudi Arabia, lahir pula gerakan anti madzhab yang mengajak kaum Muslimin agar menanggalkan baju bermadzhab dan kembali kepada “ajaran al-Qur’an dan Sunnah”. Karena menurut mereka, para imam madzhab sendiri seperti Imam Abu Hanifah, Imam Malik, Imam al-Syafi’i dan Ahmad bin Hanbal, lebih mendahulukan hadits shahih daripada hasil ijtihad. Bukankah semua imam madzhab pernah menyatakan, “idza shahha al-hadits fahuwa madzhabi (apabila suatu hadits itu shahih, maka itulah madzhabku)”.
